TERMS OF SALE


When you register (or if pre-registered pick up your bidder paddle)
you MUST give us one of these 3 items as deposit:

1.   YOUR COMPANY CHECK ALONG WITH YOUR BANK LETTER OF GUARANTEE  (IMPORTANT: this is not a "letter of credit".
Your bank must use the form found here  at:

2.   A BANK, CASHIERS OR CERTIFIED CHECK MADE OUT TO:
CONTINENTAL AUCTION GROUP

3.   $500.00 in cash.
(note: you may be asked for more cash deposit as you bid so please come prepared)

If you do not buy anything you can turn in your bidder paddle and we will return this deposit,
otherwise it will be used as deposit or for payment in full.

ALL PURCHASES MUST BE PAID FOR IN FULL AT THE CONCLUSION OF THE SALE (or when you are done bidding, you may "check-out" anytime during the sale). If bidding online you will receive an invoice by email, the funds must be wired to the account indicated on your invoice. Your purchases will be available for your removal subject to the schedule for the particular auction.

3. Online (not available for all sales), 10% deposit (based on your anticipated bids) is required via wire transfer.

When you register to bid you will be asked for a credit card when you register but this is ONLY to verify your identity, the credit card is NOT charged and cannot be used to make your payment. WE DO NOT RETAIN YOUR CREDIT CARD INFORMATION!

 

WE DO NOT ACCEPT CREDIT CARDS FOR PAYMENT.

 

Bidding online is very simple, just go to the item you want to bid on, click on the picture of that item and you will be taken to the bidders screen, SIMPLE!

 

BY PLACING A BID(S) YOU ACKNOWLEDGE AND ACCEPT THE TERMS OF SALE.

 

If you are bidding in "bulk" we must receive your deposit of 10% of the bid amount within 24 hours of making your bid.

 

You may be required to submit a deposit, you will be contacted by email if a deposit is required. If your deposit is not received your bid(s) may not be accepted.

 

Deposits must be made via wire transfer.

NO WARRANTIES.Every item and lot in the "Auction" is sold: (a) AS IS, WHERE IS AND WITHOUT RECOURSE", and (b) with no warranties, guarantees or representation of any kind or variety, whether expressed, written, implied or otherwise.

 

INSPECTION / REPRESENTATION:If you choose to bid without inspecting the items, your bids are in accordance with your investigation and due diligence NOT our descriptions or representations. You assume all risks associated with bidding without inspection.


BALANCE OF PAYMENT:If you are a successful online bidder an invoice will be emailed or faxed to you the day of the auction. The balance indicated on the invoice must be received via wire transfer by 12:00 NOON on THE DAY AFTER THE AUCTION. In the event this sum is NOT received, we may sell your items to an "under bidder" without notice or recourse of any kind.

 

SALES TAX:Sales tax will be charged and collected by Continental Auction Group on all purchases, as required by the appropriate state and local laws. The "Bidder", where applicable, must present a sales tax exemption number and locally required documents acceptable to the state in which the items are located. To qualify for any available exemption, the Bidder must sign any form required by Continental Auction Group. Out of State purchasers will not be responsible for sales tax, as long as your trucker provides a straight bill of lading showing shipment out of state via common carrier.

ADDITION TO OR WITHDRAWAL FROM SALE: Continental Auction Group reserves the right: (a) to withdraw from the sale any item or items; (b) to add and sell any item or items not listed; (c) to group one or more items or lots into one or more selling lots; (d) to subdivide any lots into two or more selling lots; and (e) to sell any/all of items listed in bulk.

 

CONDITION OF ITEMS SOLD. All information is believed to be accurate, but Continental Auction Group; (a) shall not be responsible for the correct description, authenticity, genuineness of, or any defect in, any item or lot; and (b) make no warranty in connection therewith. No allowances will be made or sale set aside on account of any incorrectness, error in cataloging or any other imperfection not noted. No deduction will be allowed for damaged articles as all goods being exposed for public exhibition are sold (I) "AS IS, WHERE IS, AND WITHOUT RECOURSE": and (ii) with no warranties, guarantees or representations of any kind or variety, whether expressed, written, implied or otherwise. Your purchases are made in accordance with YOUR evaluation of the items(s) purchased.

 

COMPLIANCE WITH THE TERMS OF SALE.If the Bidder fails to pay in full any amount owed in connection with a successful bid at the Auction within the designated time period, Continental Auction Group, in addition to all other remedies allowed by law, may retain all monies received as a deposit or otherwise liquidated damages. All items or lots not paid for within the time specified herein may be resold by Continental Auction Group at public or private sale without further notice. Any resulting deficiency, together with all expenses and costs of re-sale, will be the responsibility of the Bidder. The failure or default by the Bidder to comply fully with the terms and conditions herein will be treated as an immediate breach and any deposit or other payment that may have been made may be retained by Continental Auction Group and applied toward any deficit or additional costs or charges as incurred to effect the resale of that item or lot at private or public sale. There shall be no further notice required to the Bidder once a default has occurred. The Bidder shall be liable for all costs incurred, plus any deficit arising, from the Bidder's default.

 

PERSONAL AND PROPERTY RISK.Persons attending the sale or otherwise in attendance during the sale, exhibition, or removal of any item or lot assume all risks of damage of or loss to person and property and specifically release and indemnify Continental Auction Group from liability therefore. Neither Continental Auction Group the Seller nor any of their respective principals, officers, directors, employees or agents, shall be liable by reason of any defect in or condition of the premises in which the sale is held.

 

REMOVAL:Your purchases will be available for as indicated here on our website or in the auction catalog under “Removal” or as announced at the auction. Removal is the responsibility of the purchaser, no labor or equipment will be provided. The successful bidder(s) shall be responsible for removal of all won lots from the auction site. Items not removed in the time alloted are immediately considered abandoned. Riggers, companies or individuals disconnecting and / or moving equipment from the site will be required to supply a certificate of liability insurance in an amount no less than One Million Dollars per occurrence.
